The tender as well as the overall correspondence and documents related to the tender shall be submitted in

In expression of the price with letters, foreign economic operator may also use English. The bid shall

The performance of the electricity procurement contract will be governed by the delivery of energy in accordance with the agreed supply schedule, volume, and pricing conditions. Intermediary deliverables may include periodic consumption reports, invoicing documentation, and compliance certificates related to energy source origin (e.g., guarantees of origin for renewable electricity). The supplier must ensure uninterrupted delivery of electricity as per contractual terms, and any deviation—such as outages, under-delivery, or quality failures—may result in compensation for damages, including financial penalties or service credits.

The contracting authority shall exclude the economic operator from the public procurement procedure if itdetermines that the economic operator or the person who is a member of the management or supervisory bodyof that economic operator or has powers to represent or make decisions or supervise it in the last 5 has beensentenced for years by a final court verdict for a criminal offense which has elements of the following criminaloffenses established in the criminal code:
— participation in criminal association,
— corruption,
— tax evasion and contributions,
— terrorism or offenses related to terrorist activities,
— money laundering and financing of terrorism, and
— abuse of child labor and human trafficking.
The contracting authority shall exclude from the procedure for public procurement contract awarding everyeconomic operator:
(a) who has unpaid taxes, contributions or other public duties, unless he has been authorized to defer paymentof taxes, contributions or other public duties in accordance with special regulations and regularly pays them;
(b) is in bankruptcy or liquidation procedure;
(c) against which secondary penalty prohibition to participate in public calls, contracts for public procurementand contracts for public private partnership awarding has been passed;
(d) against which secondary penalty of temporary or permanent prohibition to perform certain activity has beenpassed;
(e) against whom misdemeanour sanction — prohibition to perform profession, activity or duty or temporaryprohibition to perform activity has been passed;
(f) who has given false data or failed to deliver the data requested by the contracting authority.
To prove their capability for performance of professional activity, the economic operators shall submit document:
— for registered activity as evidence that they have been registered as natural or legal person for theperformance of the activity related to the subject of the contract for public procurement or evidence that theybelong to appropriate professional association in accordance with the regulations of the country of registration,
— electricity supply license issued by ERC or act of registration in the registry of foreign suppliers of electricityfrom the Energy Regulatory Commission
— market participant decision issued by the market operating market (with the possibility of regulated balanceresponsibility). In addition to solutions, the provider of submission and explanation that the Student LearningHost cannot be forwarded.
To prove their capability for performance of professional activity, the economic operators shall submit document:
— for registered activity as evidence that they have been registered as natural or legal person for the
performance of the activity related to the subject of the contract for public procurement or evidence that they
belong to appropriate professional association in accordance with the regulations of the country of registration,
— electricity supply license issued by ERC or act of registration in the registry of foreign suppliers of electricity
from the Energy Regulatory Commission
— EIC code issued by MEPSO for electricity supply
— If the economic operator is BRP (Balancing Responsible Party), it should submit a Balance Responsibility
Agreement, and if the economic operator is part of BG (Balancing Group), it should submit a Balancing
Responsibility Agreement from the Balancing Responsible Party and a document for assuming a Balancing
Responsibility by on the Balancing Responsible Party for the economic operator
— Agreement that it is registered as a participant in the electricity market in accordance with the Electricity
Market Rules
