The subject of the procurement is: Suppliers – Procurement and transport of prefabricated concrete tiles, buffer, separation material (crushed material) and curbs (concrete curbs) for the settlements in the municipality of Lipkovo. A detailed description of the subject of procurement is provided in the preliminary calculations (technical specifications) attached to this tender documentation and the conditions and requirements arising from this tender documentation. The subject of procurement: divisible by parts (LOTS). The subject of procurement is divisible into parts as defined in the technical specifications. The bidder can make an offer for one, more or all parts of the subject of procurement. The bidder cannot divide the constituent elements of the individual lot. For each individual part of the procurement subject, a separate electronic auction will be conducted through the electronic system for public procurement (https://www.e-nabavki.gov.mk).

2 DETERMING THE CAPACITY OF THE ECONOMIC OPERATOR

2.1 Conditions for determining the capacity of the economic operators (Article 87 of the Law on Public Procurement)

2.1.1 When determining the capacity of the economic operators, the contracting authority verifies whether: there are grounds to exclude the economic operator from the procedure, the criteria for quality selection pursuant to Articles 89, 90, 91, and 92 of the Law on Public Procurement are met.

2.2 Grounds on which an economic operator shall be excluded from the procedure

2.2.1 The contracting authority shall exclude from the procedure any economic operator, or their executive or supervisory bodies, or any person authorised to represent the economic operator and act on their behalf in the 4 / 6 decision-making and supervision process, who has effective court decision passed against them in the course of the last five years for some of the following crimes as established by the Criminal Code: participating in criminal organization, corruption, tax and contributions evasion terrorism or terrorist-related activities money laundering, financing terrorism and child labour and human trafficking.

2.2.2 The contracting authority shall exclude from the procedure any economic operator that:

• has back taxes, back contributions and other public charges, unless deferred payment of taxes, contributions and other public charges has been approved in accordance with the corresponding regulations, and the economic operator regularly defrays those charges;

• has bankruptcy proceedings or liquidation procedure underway;

• has had а secondary penalty of prohibition to participate in public call procedures, be awarded public procurement contracts and public private partnership contracts, passed against them;

• has had a secondary penalty of temporary or permanent prohibition to perform individual activity passed against them;

• has a misdemeanour sanction passed against them – prohibition to perform professional activity or other duty, or temporary prohibition to perform certain activity, and

• has given false data or has not submitted the data requested by the contracting authority.

2.2.3 The contracting authority shall exclude any economic operator from the public procurement procedure

should they, prior to the submission deadline, find themselves on the negative references list.

2.4.1 Capacity to perform professional activity

In order to verify their capacity to perform professional activity, the economic…

… operator has to submit a document for registered activity, verifying they are registered as a natural or legal person that performs the activity related to the subject of the public procurement contract, or verification that they belong to a corresponding professional association in accordance with the regulations of the country where the economic operator is registered in.

… operators have to provide a document issued by a competent authority, verifying they meet the criteria prescribed by Law related to the subject of the public procurement.

VERIFICATION DOCUMENTS:

In order to verify their professional capacity, the economic operator has to submit:

A document for registered activity verifying that the economic operator is registered as a natural or legal person that performs the activity related to the subject of the public procurement contract, or verification that they belong to a corresponding professional association in accordance 5 / 6 with the regulations of the country where the economic operator is registered in. In the Republic of North Macedonia the authorised body for issuing such a document is the Central Register. Certificate of registered activity (form DRD)

6.4.1 The contracting parties execute the public procurement contract in accordance with the conditions established in the tender documentation and the selected most favorable offer.

6.4.2 The contracting authority will control whether the performance of the public procurement contract is in accordance with the terms of the contract.

6.4.3 During the execution of the contract, the contracting parties, in addition to the provisions of the Law on Public Procurement, will accordingly apply the provisions of the law governing the obligation relations and the material regulations governing the subject of procurement.
