Bid-securing declaration

The economic operator shall lodge a Bid-securing declaration attached to the bid.

With the declaration, the economic operator shall state that:

- shall not withdraw its bid before the expiration of validity period therein,

- shall accept the correction of arithmetic errors by the commission,

- shall sign the public procurement contract in accordance with the terms

2.2.1 The Contracting Party shall exclude any economic operator from the public procurement procedure if it determines that the economic operator, or the person who is a member of the executive or oversight body of said economic operator or who is authorized to represent or adopt decisions or to perform oversight over the economic operator, has been sentenced with an enforceable judgement in the last 5 years on committed crime that involves elements of the following crimes stipulated under the Criminal Code:

- participation in criminal organization,

- corruption,

-tax and payroll tax evasion,

-terrorism or criminal acts related to terrorist activities,

- money laundering and financing terrorism, and

- child labor and human trafficking.

2.2.2. The contracting party shall exclude any economic operator from the public procurement procedure, if an economic operator:

- has unpaid taxes, payroll taxes or other public charges, except in cases when the economic operator has been permitted to pay taxes, payroll taxes or other public charges by means of deferred payment in compliance with special provisions and performs regular payment thereof;

- undergoes bankruptcy or liquidation proceeding;

- has been sentenced with secondary penalty - prohibition for participation in public call procedures, procedures for awarding public procurement contracts and public-private partnership contract;

- has been has been sentenced with secondary penalty – temporary or permanent prohibition to perform a particular activity;

- has been sentenced with misdemeanor sanction – prohibition to perform profession, activity or duty, or temporary prohibition to perform a particular activity, or

- issues false information/data or fails to submit information/data requested by the Contracting Party.

2.2.3 The Contracting Party shall exclude the economic operator from the public procurement procedure if the economic operator is listed under the list of issued negative references under Article 101 paragraph (3) of the Law on Public Procurements by the final deadline for delivery of bids or participation requests.

Техничка и професионална способност:

I. In order to qualify as capable of performing the public procurement contract in terms of its technical or professional ability, the economic operator should meet the following minimum conditions:

1) Reference list of at least two contracts carried out in the area of the subject of procurement for the same or similar system in the last 3 (three) years with provision of confirmation for the execution of confirmation of the performed services by the recipients;

2) To have employed/engaged professional staff with the following professional qualifications for the entire duration of the contract:

• • At least one (1) person with ODCP (Oracle Database Certified Professional) certification and at least 5 years or equivalent of work experience.

• At least one (1) person with Oracle Cloud Infrastructure Foundation certification with at least 5 years or equivalent of work experience.

3) For the entire duration of the contract, the Bidder is obliged to have at his disposal persons who possess the specified professional qualifications.

4) Notification of the elements of the contract that the Bidder intends to assign to a subcontractor.

I. In order to qualify as capable of performing the public procurement contract in question, in terms of quality system standards, the economic operator should meet the following standards

- ISO 9001:2015 Quality Management Systems or equivalent

- ISO 27001:2013 Information Security Management Systems or equivalent

Минимално ниво(а) на стандарди:

II. The economic operator proves the fulfilment of the minimum conditions by submitting:

1) The fulfilment of the above conditions specified in sub point 1 of point I., which refer to the reference lists, is proved by the Bidder by attaching the following documentation: Certificate/reference for implementation and/or maintenance carried out in the last 3 years issued by the recipient of the service;

2) The Bidder proves the fulfilment of the conditions from point I subsection 2, which refer to the professional qualifications of the professional staff, by attaching the following documentation:

Regarding the method of hiring, if the person is employed, the Bidder is required to provide proof of regular employment (M1/M2 form), and if he plans to hire, he is required to submit a Statement indicating the person he intends to hire, with an additional attached written consent from the person he intends to hire. To prove the appropriate experience of the experts, the Bidder submits Statements from the experts that they possess the minimum required years of suitable experience in accordance with the requirements of the condition and by specifying the relevant projects in accordance with the appropriate condition, the company for which he has worked with the period of his engagement, whereby the years of the suitable experience will be counted from the year of the first relevant project.

3) Statement that for the entire duration of the contract, the Bidder, if selected as the Holder of the procurement, will have at his disposal persons who possess the specified professional qualifications and will be engaged in the project team;

4) Statement of notification for the elements of the contract which the Tender intends to assign to a subcontractor.

Note:

* Certificates must be valid and issued by a Certificate Authority. Certificates of attended courses are not accepted.

* Regarding the method of hiring, if the person is employed, the Bidder is required to provide proof of regular employment (M1/M2 form - with blacked-out identity numbers, or a certificate from the records of employees from the ESA or PDIFM), and if he plans to hire, he is required to submit a Statement in which he will specify the person he intends to hire, with an additional attached written consent from the person that he agrees to be hired

STANDARDS FOR QUALITY SYSTEMS

II The economic operator proves the fulfilment of the standards by submitting:

- Valid Certificate of compliance with the international standard ISO 9001:2015 Quality Management Systems from an accredited certification body, i.e. proof that a quality management system has been established, in accordance with the requirements of the international standard ISO 9001:2015 or equivalent.

- Valid Certificate of compliance with the international standard ISO 27001:2013 Information Security Management Systems from an accredited certification body, i.e. proof that an Information security management system has been established, in accordance with the requirements of the international standard ISO 27001:2013 or equivalent

The Contracting Authority will make the payment of the total cost of the Offer based on an approved record of quality delivery of the procurement item and within a 30 day term from the day of receipt of the invoice in the Contracting Authority's registry office.
